Terms of Service

By commissioning me you automatically agree to the following terms of service. I can not be held accountable for problems caused by a client's failure to read these terms.Please contact me if you have any questions.

This Terms of Service Agreement ("Agreement") is entered into between the Artist and the Client for the commission of an artwork ("Work"). By commissioning the Artist, the Client agrees to the following terms:1. Engagement
- Client provides necessary materials (i.e. references) and clear instructions, requirements and expectations upfront, before the Work begins.
- Clients grants the Artist the rights to replicate Client’s own character design, reference material and other intellectual property for the use of the Work.
- Client warrants that all materials (i.e. character design, references and other intellectual property) are legally obtained and authorised for use by the Client.
- Artist strives to perform for the best of their ability in good faith and warrants that the Work is original according to Artist’s best knowledge.
- Artist may use commercially licensed, copyright-free assets or tools.
- Artist reserves the right to refuse projects or requests for any reason.2. Timeline and Process
- Time needed for Work depends on commission type, complexity and workload.
- Artist provides progress updates and seeks Client feedback voluntarily.
- Final deliverables will be provided by the Artist using either the VGen platform, Google Drive or similar file sharing tools or E-mail in PNG or PSD format.
- In case of delays the Artist will inform the Client.3. Revisions
- Major revisions are only offered during the sketching phase of the Work.
- Minor revisions (i.e. color adjustments) are offered at any point during the Work.
- Additional charges for excessive revisions may be required.
- Revisions can affect the progress and timeline.
- Clients may not edit or commission another party to edit the work unless otherwise specified by the Artist.4. Communication
- Client and Artist will discuss the project throughout the Work.
- Communication channels may include, X DMs, Discord, Vgen DMs, E-mail.
- Artist’s response time may vary by up to 4 days.5. Rights & Usage
Artist general rights:
- Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing the Work and work in progress on websites, social media, portfolios, public boradcast channels and more, exempting when some or all of these rights are transferred to the Client under express agreement or project specifications (see commercial use).
- Artist may use rejected work in progress and versions for other projects according to their discretion, under the condition that it does not infringe on the Client’s intellectual property rights and ownership of their likeness, character design, branding, identity design or any such trademarks.Client’s rights for PERSONAL USE Licensed Works:
- Clients receive non-transferable usage rights to the Work for personal use.
- Personal use includes: Display on social media accounts for promotional purposes with no direct monetization or sales, such as social media profile pictures, banners and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels; or any other instances where monetization of, or of content featuring the Work is involved.
- Client must not claim Work as their own and must credit the Artist using their social tag/username/link at the instance of display of the Work or permanently on their website, social media profile, broadcast channels and so on where possible.Client’s rights for COMMERCIAL USE Licensed Works:
- Commercial usage rights are not included in general commissions unless specified in the commission type or project specifications listed on the Artist’s website, or is purchased by the Client and agreed upon.
- Commercial rights may differ based on commission type.
- Commercial broadcast rights means usage of Work on streams, videos, advertisements and other content, or any similar monetized instances; commercial distribution rights means selling or reselling Work to another party, as a part of any product or merchandising or on another platform.
- In the case of original design work and assets for the purpose and definition of the Client’s brand identity such as character design, Emotes and more, intellectual property rights are exclusively transferred to the Client for use, production and modification purposes, commercial or personal.
- Usage of Work for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.
- Additional charges will be required for commercial usage if not included in the project type, listing or specifications, typically 2x of the original cost.6. Payment & Fees
- Client pays the invoice (Paypal or VGen) either in full or 50% in advance and 50% when the Work is finished, but before the final Work is delivered.
- Other payment plans may be offered for returning, trusted Clients, if requested.
- Invoices, proposals or payment link will be provided to the Client by the Artist before the Work begins.
- If the invoice is not paid within a reasonable timeframe without notice, the project might be cancelled.
- Prices and invoices/proposals are in EUR and paid via VGen or Paypal.
- Prices may change or vary depending on amount of Work, complexity or additional requests.
- The Client acknowledges that the Work and deliverables are digital and there are no physically shipped goods to receive.
- Client agrees that they will not issue chargebacks and the refund policy mentioned below will be followed.7. Cancellation & Refunds
- Clients can request a cancellation before the Work has begun.
- No refunds are possible once work begins unless initiated by the Artist.
- Clients are only eligible for a full refund if the Artist is unable to start the Work.
- Clients may be eligible for a partial refund if the Artist has started the Work but is unable to complete it.8. Confidentiality
- Artist and Client agree that information and materials provided by either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information) shall be considered confidential information and will not be discolsed to any other party without prior written permission from the owner of this confidential information.9. Acceptance
- Client is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.
- Agreement date is upon first inquiry/communication or first transaction. Or by use of a digital signature program for a more legally binding and enforcable agreement if the Artist does choose to.
